Rubin Pomerleau, P.C. is seeking a full-time attorney to work in the downtown Boston firm with the day to day operations. The attorney must possess strong interpersonal, advocacy and writing skills. Criminal defense and/or prior immigration experience preferred. The attorney must have a driver's license and be able to travel to various state courts. We have Zipcar available. Spanish and/or Portuguese speaking skills a plus.
Rubin Pomerleau, P.C. is a nationally recognized firm as Attorneys Jeffrey B. Rubin and Todd C. Pomerleau were awarded the 2019 AILA Jack Wasserman's Excellence in Litigation in recognition of the SCOTUS precedential case Pereira v. Sessions leading to many thousands of clients benefiting from the ruling that a putative Notice to Appear does not trigger the stop time rule for non-LPR cancellation of removal. The firm also represented Alexandre Fernandes in the precedential decision Board of Immigration Appeals Matter of Fernandes in 2022 attending a rare oral argument in Falls Church and ultimately affording the dismissal of removal proceedings when timely objecting to a putative NTA. The firm has many more precedential decisions at the circuit courts and challenges at the federal court filed along with the ACLU that has resulted in preventing arrests of those seeking provisional waivers and exposing violations of the law by ICE in post-deportation review when clients are detained. Notably, the firm also won a case challenging the post-departure bar to Motions to Reopen at the First Circuit after the bar was struck down in Perez Santana v. Holder in 2013. Other circuit precedents the firm has represented clients for include the First Circuit holding arson in Massachusetts is not a crime involving moral turpitude in Rosa Pena v. Sessions and in another decision left open the question whether Assault and Battery with a Dangerous Weapon is a crime involving moral turpitude in Coelho v. Sessions.
Attorney Rubin began filing post conviction motions in state criminal court in 1998 and Attorney Pomerleau assisted in the briefing in Commonwealth v. Sylvain to make Padilla v. Kentucky retroactive to 1997 and eventually 1996 for certain controlled substance offenses.
Attorneys Rubin and Pomerleau have also won criminal jury trials at the federal, state superior, and district court levels. Day in and out, the dedicated team at Rubin Pomerleau fights for asylum and family based petitions to be approved while never ceasing to fight for clients at the Immigration Court, Board of Immigration Appeals, and the circuit courts. Special Immigrant Petitions are routinely approved at our firm. Rubin Pomerleau files APA complaints, Writs of Mandamus, and Habeas Corpus petitions as necessary.

Salary is negotiable depending upon experience, second language skills such as Spanish or Portuguese a plus, and a Massachusetts state bar license is required. We offer health insurance, vision and dental plans, and a retirement savings plan.
Responsibilities include both federal immigration and state court coverage. We file applications with and attend hearings associated with the USCIS, NVC, Immigration Court, Board of Immigration Appeals, U.S. Court of Appeals, state criminal district and superior courts, Massachusetts Court of Appeals, and administrative hearings.
