GENERAL SUMMARY
Plans, supervises, and coordinates legal services and legal representation to the City of Mt. Juliet (the City) and support to City Management. Advise and represent the City to ensure it functions lawfully with minimal risks.
SUPERVISION
General supervision is provided by the City Manager and Deputy City Manager.
ESSENTIAL DUTIES AND RESPONSIBILITIES
- Plan, organize, and direct the activities of the Office of the City Attorney.
- Assign duties, evaluate performance, counsel, and train legal staff; recommend/make arrangements for retention of private counsel in cases involving extensive or specialized litigation.
- Preparation and review of contracts (including real estate contracts and closings), deeds, bonds, ordinances, resolutions, and agreements for the City; assist in determining departmental policy.
- Render opinions relative to substance, form, and propriety of such documents.
- Attend Board of Commissioners meetings; provides legal counsel required by proceedings.
- Provide legal advice/assistance to the City Manager, Department Heads, boards, commissions, and other city officials regarding legal rights.
- Prosecute on behalf of the City involving violations of state/local laws/ordinances.
- Represent the City in major litigation; performs legal research as necessary.
- Mentor all parties by advising, counseling, or providing guidance on issues that may be resolved by legal or professional principles.
- Performs other duties as assigned.
KNOWLEDGE, SKILLS, AND ABILITIES
- Municipal ordinances and charter provisions, state and federal law, and constitutional law affecting municipal government.
- Judicial procedures, rules of evidence, and methods of legal research.
- Planning, organizing, directing, and supervising the work of an Assistant City Attorney, Paralegal, and additional clerical legal staff.
- Analyze, appraise, and organize facts, evidence, and precedents in difficult and complex cases and present such material in clear and logical form for oral and written presentations, in briefs, opinions, orders, or decisions.
- Establish and maintain effective working relationships with elected officials, city employees, and the public; skill in negotiating, facilitating, and mediating.
- Highly adept in dealing with specific legal matters relating to civil rights, workers’ compensation, governmental immunity, tort and contract litigation, contract negotiation, administrative law, and federal regulations.
- Conduct and/or supervise legal research; proficient in using discretion and diplomacy when dealing with elected officials, City staff, the public and adversaries.
REQUIRED EDUCATION AND EXPERIENCE **
- Doctor of Jurisprudence and four (4) years of professional legal experience.
LICENSES AND CERTIFICATES
Licensed to practice law in the State of Tennessee or permitted to practice law pursuant to applicable rules of the Tennessee Supreme Court.
PHYSICAL REQUIREMENTS / WORK ENVIRONMENT
Work involves everyday risk or discomfort requiring normal safety precautions typical of office work. The work area is adequately lighted, heated, and ventilated. Work is primarily conducted in an office setting under generally favorable conditions with occasional walking, standing, bending, and carrying of items. Position may require investigative trips in the field. No special physical demands are required to perform the duties of this position.
