These services will include:
· Reviewing records, briefs, and related case documents.
· Analyzing arguments and applicability of precedent cited by parties, issues, and facts presented.
· Conducting legal research relating to the interpretation and application of the Federal Service Labor-Management Relations Statute, 5 U. S. C. § 7101 et. seq., the Fair Labor Standards Act of 1938, as amended, and other laws, rules and regulations including but not limited to the Civil Rights Act of 1964, the Equal Educational Opportunities Act of 1974, the Americans with Disabilities Act and Titles 5 and 29 of the Code of Federal Regulations.
· Determining the statutory or contractual obligation of Departmental management to communicate, consult, or negotiate with the (client) exclusive representatives concerning conditions of employment during the term of existing respective CBAs.
· Maintaining close day-to-day working relationships with (client) officials at varying organizational levels and with union representatives for purposes of enhancing a uniform interpretation and application of CBAs and employee and labor management relations policies and practices throughout the Department
· Providing broad and varied expert technical assistance and support to the Department's bargaining team in preparing for negotiating agreements with (client).
· Drafting decision papers concerning a variety of complex and controversial issues in the field of employee and labor relations exclusive to labor organizations
· Preparing draft issues memoranda and draft decisions in connection with the resolution of grievances, information requests, negotiability, arbitration, unfair labor practice, and representation cases arising under the applicable statutes, laws, regulations, and policies
· Assisting with post-petition conferences in negotiability cases with representatives of the parties and in other training, facilitation, and/or alternative dispute resolution activities · Assisting with training or other presentations
· Providing advice and assistance to managers and supervisors in database and client organizations regarding grievances, adverse and performance-based actions, disciplinary actions, and appeals
· Draft disciplinary/adverse actions
· Conduct investigations regarding employees’ misconduct
· Assessing the validity of grievances arising out of the interpretation and application of CBAs and the interpretation or application of Departmental regulations with respect to personnel policies, practices, and other matters affecting working conditions.
· Meeting with union officials and acting as the representative of Department management in negotiating resolutions for the settlements of grievances, unfair labor practice charges, and unit determinations of a complex nature.
· Serving as an expert, and as necessary, as a witness, in matters involving the Merit Systems Protections Board, Equal Employment Opportunity, Federal Labor Relations Authority, administrative and negotiated grievance hearings, or those held by other appropriate authorities.
· Providing accurate interpretations of the (client) appraisal system and program and any related processes while clarifying program policy applications.
· Conducting comprehensive legal research related to the Federal GS appraisal program, ensuring a deep understanding of current legal frameworks, decisions, and guidelines that influence performance management policies and practices.
· Using applicable performance management-related case law, legal decisions that set precedent, research databases, and regulatory citations to support all performance guidance.
· Preparing consistent and appropriate recommendations, feedback, and/or guidance related to performance management for clients and all stakeholders.
· Providing relevant and comprehensive feedback on stakeholders' draft performance management plans in accordance with the requirements of the Federal appraisal system, (client) appraisal Program, and internal annual guidance.
· Strictly adhering to performance management SOPs and assisting customers in drafting error-free performance improvement plans (PIPs). Providing accurate and interpretative guidance on performance improvement processes to internal and external stakeholders to clarify procedural requirements before addressing unacceptable performance, as specified in 5 U.S.C. 4303/ 5 C.F.R. 432.
· Actively participating in team initiatives, discussions, and other ad hoc assignments. Developing and/or accurately revising program-related tools and resources. Participating in and/or coordinating program initiatives and training events for the Performance Management Branch.
· Ensuring all performance management responses to stakeholders are thought-through, professional, and well-written; and, if applicable, supported by statutory and/or Departmental citations. Preparing written products, guidance, and presentations that are clear, concise, understandable, and include logical organization/flow. Reviewing and proofreading existing resources to ensure accuracy.
· Strictly adhering to and tracking performance management Service Level Agreement (SLA) data.
· Actively participating in performance management initiatives, discussions, and other ad hoc assignments. Developing and/or accurately revising program-related tools and resources. Participating in and/or coordinating program initiatives and training events for the Performance Management Branch.
· Advising and identifying settlement opportunities and strategies for all performance-related legal matters handled by the (client) Solicitor’s Office.
· Exhibiting a full understanding of all performance management regulations in relation to other functional areas like Employee Relations, Labor Relations, and Investigations.
